Yes, H-1B visa holders can start a business in the United States, BUT they MUST


  1. be passive in their role 
  2. not be working for the business in any capacity. 
  3. consult with an immigration attorney to evaluate their entrepreneurial pursuits 
  4. avoid violating their H-1B status
